These Terms of Service (“Terms”) govern access to and use of the CheerKeeper platform, including the CheerKeeper website, mobile applications, software services, and related tools (collectively, the “Platform”).
The Platform is operated by CheerKeeper, LLC, a Maryland limited liability company (“CheerKeeper,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to these Terms.
If you do not agree with these Terms, you may not use the Platform.
1. Purpose of the Platform
CheerKeeper provides software tools designed to help cheerleading gyms, dance studios, and youth athletic organizations coordinate competitions, schedules, and communications between coaches, athletes, and families.
The Platform may allow:
- competition schedule coordination
- practice and team scheduling
- athlete participation tracking
- event notifications
- communications between authorized participants
The Platform is intended for use by athletic organizations, coaches, parents, and authorized users participating in youth sports activities.
2. Eligibility
Users must be at least 18 years of age to create an account unless the account is created and supervised by a parent, guardian, or athletic organization.
If you are a parent or legal guardian creating an account on behalf of a minor athlete, you represent that you have authority to provide consent for the minor’s participation in the Platform.
3. Accounts
Certain features require the creation of an account.
Users agree to:
- provide accurate information
- maintain the security of login credentials
- notify CheerKeeper of unauthorized account access
- update account information when necessary
Users are responsible for all activities conducted under their account.
4. Use by Athletic Organizations
Gyms, studios, and athletic organizations using CheerKeeper are responsible for:
- supervising staff and coach use of the Platform
- ensuring communications with minors comply with applicable child protection policies
- obtaining required parental consent before entering youth athlete data
- ensuring that information entered into the Platform is accurate
Organizations are responsible for ensuring that their staff comply with applicable youth protection laws and governing body rules.
5. Youth Athlete Data and Parental Consent
Because the Platform may involve youth athletes, parental or guardian consent may be required before certain personal information is submitted.
Parents or guardians are responsible for:
- reviewing athlete information entered into the Platform
- requesting corrections where necessary
- supervising their child’s use of the Platform where applicable
Athletic organizations are responsible for ensuring that parental consent has been obtained before youth data is submitted.
6. Acceptable Use
Users may only use the Platform for lawful purposes related to legitimate athletic activities.
Users may not:
- upload unlawful or abusive content
- impersonate another person
- harass or threaten other users
- attempt to gain unauthorized system access
- interfere with system security or operations
- collect or scrape user information without authorization
Violation of these rules may result in suspension or termination of access.
7. Child Safety and Communications
Because the Platform may facilitate communication involving youth athletes, users must conduct themselves appropriately and in compliance with youth protection policies.
Users must not:
- use the Platform to engage in inappropriate communications with minors
- attempt to contact minors outside authorized team or organizational contexts
- use the Platform to bypass athlete supervision requirements
Athletic organizations are responsible for supervising communications conducted through their accounts.
CheerKeeper may investigate suspected misuse of the Platform involving youth safety.
8. Mandatory Reporting and Abuse Concerns
If a user becomes aware of suspected abuse, exploitation, or inappropriate conduct involving minors through the Platform, they should report the matter to the appropriate authorities or governing bodies.
CheerKeeper may cooperate with law enforcement or regulatory authorities when required by law.
9. User Content
Users may submit information through the Platform including:
- schedules
- team rosters
- messages
- event information
Users retain ownership of the information they submit.
By submitting content to the Platform, users grant CheerKeeper a limited license to process and display that information in order to operate the Platform.
Users represent that they have the legal right to submit the information they provide.
10. Prohibited Data
Users must not upload sensitive personal data including:
- Social Security numbers
- financial account numbers
- payment card data
- government identification numbers
- passport numbers
The Platform is designed for scheduling and coordination purposes and should not be used to store highly sensitive personal data.
11. Data Privacy
CheerKeeper processes personal information in accordance with its Privacy Policy.
Where applicable, additional protections may apply under:
- Children’s Online Privacy Protection Act (COPPA)
- state privacy laws
- international data protection regulations
Users should review the Privacy Policy to understand how personal information is handled.
12. Security
CheerKeeper maintains reasonable safeguards designed to protect Platform data including:
- encrypted communications
- authentication controls
- monitoring and system protections
However, no internet-based system can guarantee absolute security.
Users are responsible for maintaining secure passwords and protecting their devices.
13. Security Incident Responsibility
Security of accounts depends in part on the actions of users and organizations.
Users are responsible for:
- protecting login credentials
- securing devices used to access the Platform
- preventing unauthorized account access
CheerKeeper is not responsible for security incidents resulting from compromised user credentials or misuse of the Platform.
14. Third-Party Services
The Platform may integrate with third-party services including:
- competition organizers
- messaging providers
- cloud infrastructure providers
CheerKeeper is not responsible for the practices or actions of third-party services.
15. Schedule and Event Information
Competition schedules and event details may be provided by third-party organizers or athletic organizations.
CheerKeeper provides tools to communicate scheduling information but does not control event schedules.
CheerKeeper is not responsible for:
- schedule changes
- event cancellations
- inaccurate information provided by third parties
Users should confirm event information with official competition organizers when necessary.
16. Service Availability
CheerKeeper will make reasonable efforts to maintain reliable access to the Platform.
However, the Platform may occasionally be unavailable due to:
- maintenance
- infrastructure issues
- internet outages
- security incidents
CheerKeeper does not guarantee uninterrupted availability.
17. Termination
CheerKeeper may suspend or terminate access to the Platform if a user:
- violates these Terms
- misuses the Platform
- creates risk to other users
- engages in unlawful activity
Users may stop using the Platform at any time.
18. Intellectual Property
All software, design elements, trademarks, and intellectual property associated with the Platform remain the property of CheerKeeper.
Users may not reproduce or distribute the Platform without authorization.
19. Limitation of Liability
To the maximum extent permitted by law, CheerKeeper will not be liable for indirect, incidental, or consequential damages resulting from use of the Platform.
20. Governing Law
These Terms are governed by the laws of the State of Maryland.
Any disputes must be resolved in the courts located in Anne Arundel County, Maryland.
21. Changes to These Terms
CheerKeeper may update these Terms periodically.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
